The rules that matter in Massachusetts

Massachusetts rules for employer health coverage
RuleWhat it means
Merged marketIndividuals and employers with 50 or fewer employees buy from the same risk pool, at the same rates.
Individual mandateAdult residents must have coverage that meets Minimum Creditable Coverage (MCC) standards or pay a state tax penalty. Employers aren't required to offer MCC-compliant plans, but their employees are judged against it.
Form MA 1099-HCInsurers send it for insured plans. Self-insured and level-funded employers, and non-Massachusetts employers, must send it to Massachusetts residents and file it with the DOR by January 31.
HIRD formEmployers with 6 or more employees in Massachusetts file a Health Insurance Responsibility Disclosure each year.
EMACThe Employer Medical Assistance Contribution, a payroll assessment on employers with more than 5 employees.
Mini-COBRAFully insured employers with 2–19 employees must offer continuation, generally up to 18 months (29 with a disability, 36 for some dependents).

What to check before you choose a plan

  • Ask whether the plan meets MCC for your Massachusetts employees, and who issues the 1099-HC.
  • Put HIRD and EMAC on your annual calendar; they apply no matter which plan you choose.
  • If you have employees in other states, make sure one plan works for all of them.
